19. Binding Arbitration & Class Action Waiver

(each a "Claim") will be resolved through binding individual arbitration rather than through a lawsuit in court.

Arbitration Process

Arbitration will be administered by the American Arbitration Association ("AAA") under its applicable rules.

Claims will be heard by a single arbitrator.

Unless the parties agree otherwise, arbitration will take place in Osceola County, Florida, although the parties may participate in person, by telephone or video where permitted, or through the submission of documents, subject to the applicable arbitration rules.

The arbitration agreement will be governed by the Federal Arbitration Act ("FAA") to the extent applicable.

The arbitrator will issue a written decision explaining the basis for the award where required by the applicable arbitration rules or law.

Unless applicable law, an arbitration rule, or an award provides otherwise, each party will be responsible for its own attorneys' fees, expert expenses, and other costs.

Arbitration Opt-Out

You may opt out of this arbitration agreement by providing Jarhead Aromatics with written notice within 30 days of the date you first purchase a Jarhead Aromatics product or Service.

Your written opt-out notice must include:

1. Your full name;
2. Your mailing address; and
3. A clear statement that you do not wish to resolve disputes with Jarhead Aromatics LLC through arbitration.

Your decision to opt out of arbitration will not adversely affect your relationship with Jarhead Aromatics.

You are responsible for ensuring we receive your opt-out notice. You may wish to use a delivery method that provides confirmation of delivery.

An opt-out request received after the 30-day deadline may not be valid to the extent permitted by applicable law.

Class Action Waiver

To the fullest extent permitted by law, you and Jarhead Aromatics LLC agree to bring Claims against one another only in an individual capacity and not as a plaintiff or class member in a class, collective, consolidated, or representative proceeding.

Unless both parties agree otherwise in writing, an arbitrator may not consolidate the claims of multiple individuals or preside over a class or representative proceeding.

Any dispute concerning whether the Class Action Waiver itself is enforceable, unconscionable, void, or voidable will be determined by a court of competent jurisdiction where required by applicable law.

20. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law.

Any unenforceable portion will be severed from these Terms without affecting the validity or enforceability of the remaining provisions.

21. Termination

These Terms remain effective while you use our Services.

You may stop using our Services at any time.

We may suspend or terminate your access to all or part of the Services if we reasonably believe you have violated these Terms, engaged in unlawful or abusive conduct, interfered with our systems, or otherwise misused the Services.

Termination does not eliminate obligations or liabilities that arose before termination.

Any provisions that by their nature should survive termination will continue to apply.

22. Entire Agreement

These Terms, together with the policies and operating rules referenced on our website, constitute the entire agreement between you and Jarhead Aromatics concerning your use of the Services, except where a separate written agreement expressly applies.

They replace prior or contemporaneous agreements, communications, or proposals concerning the same subject matter.

Nothing in this section deprives you of consumer protections that cannot legally be waived under the law applicable to you.
